1. Overview & Business Scope

Matcha Diamonds operates an e-commerce platform specializing in the sale of natural, earth-mined loose gemstones and fine jewelry. Because our inventory consists of high-value, one-of-a-kind natural materials, specific rules regarding purchasing, stone settings, and custom orders apply to all buyers.

2. Natural Gemstone Disclosures & Light Reactivity

  • Inherent Characteristics: By buying from us, you acknowledge that natural, earth-mined gemstones feature unique internal characteristics, including microscopic silk, inclusions, and color zoning. These are not considered manufacturing defects.

  • Ambient Light Shifts: Natural gemstones (specifically natural sapphires) are dynamically reactive to ambient lighting conditions. Variations in color hue between indoor artificial lighting and natural outdoor sunlight are normal properties of the material and do not constitute a misrepresentation of the item.

  • Media Accuracy: While we provide raw, unedited, and unenhanced macro media taken via standard high-definition lenses to show true-to-life details, display settings on a buyer’s device may slightly alter perceived color.

3. Custom Fine Jewelry & Sourcing (Final Sale)

  • Bespoke Engineering: All custom-made fine jewelry, pieces manufactured to specific finger sizes or CAD specifications, and custom-sourced loose gemstones are 100% Final Sale.

  • Cancellation Deadlines: Production or procurement begins immediately after design approval or deposit. Custom and bespoke orders cannot be modified, canceled, or refunded under any circumstances once processing has commenced.

4. Third-Party Bench Jeweler & Setting Disclaimer (Limitation of Liability)

  • Loose Stones Risk: Matcha Diamonds is entirely exempt from liability if you purchase a loose gemstone from us and hand it over to an outside bench jeweler, designer, or third-party craftsman for setting, mounting, or resizing.

  • No Damage Coverage: Gemstones are subjected to physical stress during the setting process. We are not liable for any chipping, cracking, fracturing, loss, or damage that occurs to a gemstone while in the hands of a third-party jeweler. Any issues arising during setting must be resolved directly between the buyer and their chosen jeweler.

5. Limitation of Liability & Maximum Remedy

To the maximum extent permitted by applicable law, Matcha Diamonds, its directors, employees, or partners shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of our products.

Maximum Liability Cap: In no event shall our total aggregate liability to you for all damages, losses, or legal causes of action exceed the exact dollar amount you paid to Matcha Diamonds for the specific product in dispute.

6. Shipping, Passing of Title, and High-Value Insurance

  • Adult Signature Rules: All shipments are sent via high-security couriers and require a mandatory adult signature upon delivery.

  • Transfer of Risk: Risk of loss and title for all physical items pass to the buyer the exact moment the courier notes a successful delivery confirmation or signature verification at your designated destination address. We are not responsible for packages stolen or misplaced after a verified delivery has occurred.

7. International Customs, VAT, and Import Duties

If you order from outside the United States, you are legally considered the importer of record. You must comply with all laws and regulations of the destination country. Matcha Diamonds is not responsible for international customs delays, and the buyer is solely responsible for paying all local import duties, VAT, customs clearance fees, and regional taxes.

8. Governing Law and Legal Venue

These Terms of Service and any separate purchase agreements shall be governed by, interpreted, and construed exclusively in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles. Any legal actions, lawsuits, or disputes arising directly from these terms must be filed and litigated strictly in the state or federal courts located within the State of New Jersey.

9. Severability & Updates to Terms

If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. This determination shall not affect the validity and enforceability of any other remaining provisions.
